Former Elmo voice actor Kevin Clash can finally breathe now.
Back in 2012, Clash was accused of allegedly asexual abusing multiple men more than 10 years earlier. He resigned from Sesame Street as a result.
The U.S. Court of Appeals threw out three cases, thus agreeing with a New York judge’s July decision to dismiss the lawsuits.
“The case was dismissed because of the statute of limitations. There is no ruling on the merits,” the plaintiffs’ attorney Jeff Herman. “The case against Clash on behalf of Sheldon Stephens is pending.”
It’s not over yet though. Pennsylvania man Sheldon Stephens sued Clash in March 2013, claiming Clash smoked crystal meth as he sexually abused him at age 16. The state has a more lenient policy toward statute of limitations.
